NCU #20-94 <br />VARIANCE #12-94 <br />ORDER AMENDING HEARING EXAMINER DECISION <br />On December 1, 1994, subsequent to � public hearing, the Hearing Examiner of the City of <br />Everett approved variances and an Expansion of a Non-Conforming Building Fermit for the <br />Second Baptist Church. The variances allowed encroachment of the west side yard <br />setback. <br />On January 9, 1995, the Applicant requested an amendment to the va, iances to allow a 36" <br />x 60" platform/porch lift adjunct to the south side of the west exit porch. The lift will allow <br />access to the main floor and sidewalk for handicapped persons and will be consistent with <br />the American Disability Act. The Applicant proposed to expand the west concrete wall< 4' to <br />the south for ;he access f�om the Virginia Street sidewalk. <br />The City of Everett Planning Department reviewed ihe requested amendment and <br />recommended approval. <br />Because of the minor nature of this request, no additional hearings are required. <br />The following findings of facts are made to support ttie amendment: <br />The requested lift will be approximately 36" x 60" and extend into the required 10' <br />side yard setback area fur the property located at 2801 Virginia Avenue, Everett, <br />Washington. A variance is requested in order to allow wheelchair lift access to the <br />church located on-site. <br />2. The same circumstances and facls that supported the grant of the original variances <br />are applicab�e to the instent requested modification. <br />3. At the public hearing there wes no adver :e testimony with regard to the variance <br />requests. No appeal was filed of the originel roquQst. The request is a minor <br />modification. <br />4. The criteria for variances within the City of Everett have bten reviewed, and the <br />proposed amendment satisfies these crite.ria in the same manner as set forth in the <br />original findings of facts. <br />The following conclusions are made to suppc ! the am �ndment: <br />The requested modification for a variance and the Expansion of a Non-Conforming <br />Building Fermit for the Second Baptist Church is reasonable. The requestecl <br />variance modification is to aliow intrusion into the 10' side yard setback area in order <br />tc develop a wheelchair lift to provide handicap accessibility. <br />
