Visscher <br />4708 West View Drive VIA CERTIFIED MAIL <br />Everett, Washington 98203 RETURN RECEIPT REQUESTED <br />RE: (31-93) Vacant Lot-4600 block of West View Drive <br />Lot 28, View Acres Division No. 2 <br />Dear Mr. Visscher, <br />It has been brought to our attention and verified through on -site <br />inspection that you have recently begun logging and clearing your <br />property in the 4600 block of West View Drive, without having <br />obtained a cleari - permit from the City of Everett Public Works <br />Department. Thi- s of particular concern in this case, as this <br />property is adjacent to and within the required buffer of a <br />riparian stream corridor, which it appesrs you have disturbed. <br />Streams, wetlands and their adjacent buffer areas are protected <br />and regulated by the Environmentally Sensitive Areas Section of <br />the Everett Zoning Code, Chapter 19.37 of the Everett Municipal <br />Code. The recent clearing activity on this property constitutes <br />a violation of this code. You are hereby notified to cease and <br />desist from any further development activities on this property <br />until proper permits have been applied for and received. <br />Additionally, you must submit a restoration plan for all areas <br />disturbed within 75 feet of the riparian wetlands adjacent to the <br />stream corridor. Species to be planted include red alder, <br />western red cedar, and red osier dogwood. <br />The failure to cease this activity and correct this violation <br />will make you subject to the penalties for violations as provided <br />for in Chapter 1.20 EMC, which are a misdemeanor subject to a <br />fine of not more than $1000 per day.
