( <br /> ; := � <br /> PLANNING DIRECTOR DETERMINATION <br /> Review Process II #01-008 - �� <br /> � <br /> INTRODUCTION: The City of Everett Planning Department received an application from <br /> David Russian and Maria Vicens, 1602 Rucker Ave, Everett, W� 98201, for a remodel and <br /> addition to their existing single family residence located at 1602 Rucker Ave. The existing <br /> residence is approximately 36 feet in height. A new addition with second story at the rear of <br /> the house will have a height of approximately 32 feet. This is higher than the 28-foot height <br /> limit permitted under the City's current zoning code. hlowever, the addition would be lower <br /> than the existing roofline of the residence and would be permitted subject the Planning <br /> Director Review Process II. <br /> The existing residence was originally constructed in 1905 according to the Snohomish County <br /> Assessor's records and is a Iegal non-conforming structure. Section 38.040 allows for the <br /> Planning Director to permit the expansion of a structure which does not meet required <br /> setbacks or height, provided that the expansion does not make tha setback or height more <br /> nonconforming; and that the expansion complies with all other requirements of the zoning <br /> code ordinance. I <br /> FINDINGS: The property is located in the Fi-2li, Sin�le Family Residentiai Zone. The typical <br /> building height permitted is 28 feet. The existing residence is approximately 36 feet in height. <br /> It was ongmally constructed in 1905 according to the Snohomish County Assessor's records. <br /> The zoning code requirements regulating building height for single family residential structures <br /> became effective December 1, 1956 and allowed for 35 feet. The current code adopted <br /> January 13, 1990 limited the height to 28 feet. I <br /> DECISION: The Planning Director has determined to allow for the proposal with the following <br /> conditions: <br /> 1. All necessary building permits are to be obtained from the City of Everett's Building <br /> Department. <br /> Right to Appeal: The applicant or owner of propeRy located adjacent to the subject property . <br /> or any property owner who deems himself aggrieved and will thereby suffer a direct impact <br /> from the proposal may appeal the Planning Director's determination as to whether or not the <br /> proposal shouid be permitted. Any such appeal must be filed within fourteen (14) calendar <br /> days of the date specified below. Appeal forms are available from the Planning Department <br /> and must be submitted alo�g with the required fiiing fee.
