Tlie addition on the south side of the residence will be within the five foot side <br /> setback. The proposal must meet the following conditions: <br /> 1. The applicant must obtain building pemtits as required by the Building Department. <br /> � 2. The proposed addition cannot encroach closer into the south side setback than the existing <br /> residence. <br /> The Planning Director approved the request based on the following: <br /> 1. Section 38.040 allows the expansion of a residence that is nonconfortning in setback <br /> � subject to Review Process II.A. Review Process II.A involves a written decision by the Planning <br /> , Director who may attach to any pertnit approval such conditions as may be necessary to assure <br /> compliance with the zoning code or other regulations. (Section 42.t00.A). <br /> 2. The cxisting residence is approximately 4 feet from the south property line. The zoning <br /> code requires a five foot side setback. The residence's setback has been certi6ed as a <br /> nonconfortning setback (See NCBIdg #3-96). The addition will setback the same distance Gom <br /> the south property line(See attached site plan). <br /> The applicant may appeal the Planning Director's determination. My such appeal must be filed <br /> within ten (10) calendar days of the date specified below. Appeal forms are available from the <br /> Planning Department and must be submitted along with the required filing fee.
