NOTE: <br />This agenda item came in from Mr. Heinzen after he had discussed the�� <br />matter of his sign location wit!) the appropriate City departments, and a 1 <br />learned that he could not receive a permit for the location he wants, but <br />that the ordinance does provide for an appeal to the City Council for an <br />exception to the code. <br />There is 9 feet of City right of way between his property line and the 5-ft. <br />sidewalk, making 14 feet to the curb on Rucker. His sign is 9 feet wide. <br />For maximum visibility, he would like to install it with one side inside <br />his property line and the rest of it extending approximately 8 feet into <br />the City right of Wray, or about a foot from the edge of the sidewalk and <br />approximately even with the existing light poles. <br />Section 5 of the existing ordinance reads: "No sign structure, support, pole, <br />stand, brace or appurtenance of any sign shall be placed on public property. " <br />It also reads: "It is the intention of this ordinance that no sign shall extend <br />over public property more than 10 feet and in no event shall be closer than <br />5 feet to the curb line. " <br />Section C-3 reads "Any person aggrieved by a final determination of the <br />Building Inspection Department shall have thf- right of further appeal to <br />the City Council....... The decision of the City Council shall be final. " <br />Mr. Heinzen will be at the Council meeting at which this is discussed to <br />present his appeal in person. <br />bn. <br />
