6-11-1996 4:14PM FROM EVErETT CITY ATTNY 206 259 W93 <br />P. 2 <br />RISK ACCZPTAHM AM <br />wRROW0111 <br />JUN 1 8 1996 <br />......................................................... <br />CITY OF EVERETT <br />Public Works Dept. <br />RZLZABZ <br />Whereas, the Everett Clinic has made application with the City of <br />Everett for an expansion of its Main Campus; and <br />Whereas, the City of Everett issued a decision and a SEPA MDNS <br />authorizing the expansion; and <br />Whereas, the City's decision and MDNS are subject to a fourteen <br />(14) day appeal period; and <br />Whereas, the Everett Clinic provided the City with a petition <br />signed by concerned citizens who previously expressed some <br />opposition to the expansion acknowledging that they do not oppose <br />the Everett Clinic proceeding with the utility work related to <br />the project; and <br />Whereas, the Everett Clinic knowing and recognizing that there <br />are numerous uncertainties with proceeding with the utility work <br />related to the project at this time since the appeal period for <br />the Main Campus Expansion Project has not yet expired including, <br />but not limited to, that there could be an appeal filed that <br />would preclude and/or delay the issuance of permits for the <br />project, that the project could be denied, modified or <br />substantially delayed, and that the construction of the proposed <br />parking garage and outpatient services building may not be <br />allowed; and <br />Whereas, knowing and recognizing the risks attendant with <br />proceeding with the utility work at this time, the Everett C1_nic <br />desires to proceed at this time understanding that it bears the <br />risk of so doing and will not hold the City of Everett <br />responsible; <br />NOW, THEREFORE, THE EVERETT CLINIC AGREES AS FOLLOWS: <br />In consideration of the City of Everett authorizing the Everett <br />Clinic to proceed with the utility relocation work related to the <br />Main Campus Expansion Project at this time, and without which the <br />1 <br />
