June 6, 1977 <br />The segular meeting cf the Everett Board of Adjustment was held at <br />7:30 p.m. in the City Hall Council Chamber, City Hall, Everett, <br />Washington. <br />Mr. Haird nresided; Mr. Russell, Mr. Black, and Mr. Kristiansen <br />were present. Mr. Rerg was absent. <br />A hearing was held on the application of. Robert Champion, 1712 <br />Pacific, Everett, S•7A, 98201, for a variance from Section 18.20.050 <br />E.M.C. (Everett Municipal Code), Paragraph C, Rear Yard Require- <br />ments� f.or permission to build to within thirteen (13) feet of the <br />rear property line rather than the code requirement of twenty ('l0) <br />feet. <br />Also, to project with a cantilever four (4) feet ir.to the rear <br />yard sethack. <br />LF.GAL DESCRIP7'ION: The N. ].5' of Lot 28 and all of Lots 29, 30, <br />31, and 37., Block 3, Climar. Champion represented himself and elaborated on the improvements <br />to ihe area his t�ew nrcposed building tvill offer. <br />There was no opposii:ion from the audience. <br />After visually vietaing the subject property and considering all tl�e <br />facts, it was moved by Mr. Black, seconded by Dir. KrisCi.ansen, a�id <br />unani.mously carried to grani. the applicant's request for the <br />followiny reasons: <br />].. There are exceptional circum:tances applyin9 to the <br />suUject property as to the i.ni:ended use thereof, that- <br />do not apply generally to oiher properties in the same <br />vicinity or zone. <br />2. That such vari.ance is necessary for the preservation <br />and enjoyment of a subsL-antial property right of the <br />appellant possesse�] by the owners of other properlies <br />in the same vicinity. <br />3. Tlie authorization of the variance will not be materially <br />detrimenial to the puUlic wclfare or injurious to property <br />in the vicinity or zone in Hhich the propert-y is located. <br />4.
