FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />That the variance is necessary because of exceptional or extraordinary <br />circumstances regarding the size, shape, topography, or location of the <br />subject property; or the location of a pre-existing improvement on the <br />subject property that conformed to the zoning code in effect when the <br />improvement was constructed. <br />a. Find(ngs: The applicant states that the subject property has <br />unique circumstances regarding the location of the building on <br />the subject site and an existing non-conForming sign structure. <br />The subject property has an existing freestanding sign that is <br />considered nonconfortning with regards to height. This sign <br />was constructed in 1953, and later remodeled and replaced in <br />1983. At that time the City approved the sign to a height of 24 <br />feet with no setback from the property line. The sign was <br />constructed in accordance with all permit requirements in <br />effect at the time. <br />Due to a street widening project, the applicant is proposing to <br />relocate the sign 75 feet north of its current location on site. <br />The sign area and height will remain the same, however the <br />new sign will only be setback 2 feet from the east and west <br />property lines rather than the required 9%,. The applicant has <br />stated that due to the irregular shape of the lot, and the <br />location of the existing strudure on site, the proposed location <br />of the sign is the only possible area for a sign on site. The lot <br />is triangular in shape measuring 75 feet wide along the south <br />property line, and narrowing to 10 feet wide across the north <br />property line. In order to maintain any visibility of the sign it <br />needs to be located as far north on site, so that the existing <br />buildinq does not block the sign. <br />b• Concluslona:. The existing structure was constructed prior <br />to zoning code standards coming into effect, and therefore the <br />structure would be considered legal nonconfortning related to <br />setbacks and height. The applicants proposat for the setback <br />variance and sign height at the proposed setback are <br />necessitated by the unique features of the site, in particular <br />the location of the existiny �uilding on site, ae well as the <br />irregular shape o( lhe lol. The new sign will actually be <br />moving towards conformance, by providing for some setback, <br />rather than the zero setback it has existing. The proposed <br />location of the sign takes into account the limitations of the <br />site, while still providing for visibility of the sign. All other <br />aspects of the sign will be in compliance with current code <br />requirements. <br />
