4. The Boeing Company agrees to pay to Darrell and Roma <br />Freudenberg an additional sum of Seven Thousand Five Hundred <br />($7,500.00) Dollars. <br />5. It is further agreed that The Boeing Company will lend <br />its reasonable assistance and expertise in completing any SEPA <br />application which Freudenbergs will need to comply with in order <br />to perform the covered work. <br />6. The City of Everett agrees to actively and in a <br />positive manner, in cooperation with The Boeing Company, pursue <br />the approval, without undue delay, hinderance, or the imposition <br />of unreasonable conditions, for the restoration of Powder Mill <br />Creek. <br />IT IS FURTHER AGREED that, in exchange for the foregoing, <br />Mr. and Mrs. Freudenberg will and hereby do release and discharge <br />the Boeing Company and the City of Everett from all claims, <br />causes of action for damages and liability to person or property, <br />arising out of surface and ground water flow, quantity and <br />velocity of Powder Mill Creek. <br />IT IS FURTHER AGREED that such release, however, shall not <br />be a bar to a potential inverse condemnation action with the City <br />of Everett relating specifically to the city's environmentally <br />sensitive areas land use regulations. <br />IT IS FURTHER AGREED that Mr. and Mrs. Freudenberg will, <br />upon execution of this agreement, withdraw their appeal of the <br />decision of the City of Everett imposing mitigation on the <br />proposed expansion of the Boeing -Everett airplane manufacturing <br />
