We take exception to the <br />following: <br />1. Award of the contract and authorization to purchase <br />piles must be made seven weeks prior to start of any <br />construction. <br />2. The project performance schedule furnished by Dames and <br />Moore is modified, said modification is included as <br />part of our submittal. <br />3. Our bid price does not include the cost of the building <br />permit or any other permits necessary to perform the <br />work within the City of Everett. All costs associated <br />with obta<.ning said permits shall be added to our Lump <br />Sum price. <br />4. Exhibit B, Complete Waiver of Risk and Release of <br />Liability: We will not sign this agreement as written. <br />We cannot excuse negligence on the part of others <br />should such negligence cause accidents or damage to us <br />or those associated with us. <br />Very truly yours, <br />MALCOLM DRILLING COMPANY, INC. <br />Philip L.
