6 <br /> 8. Tha[ the provision herein for reimbursement relates to costs of the Utility <br /> anly. No reimbursement shall be made to Owner for the cost of local lines serving <br /> only his property. <br /> 9. The City shall never be liable under this Agreement or otherwise to pay <br /> any of the costs of the Utiliry referred to herein. Owner agrees to releo:.:. and waive <br /> any claims for any liability of the City in establishment and enforcement of this <br /> Agreement. The City's function herein is simply to compute and receive the latecomer <br /> fees and to transmit the same ro the Owner; all such fees shall be paid wi[hout <br /> computation of any interest; fees of less than 525 need not be coilected or transmitted. <br /> The City shall pay the Owner the sum agreed by it to be collected <br /> pursuant to the provisions of the preceding pangnph, within sixty (60) days after <br /> receipt thereof at the address of the Owner as set forth hereinafter or at such other <br /> addresses as the Owner shall provide by certified mail. <br /> The City shall not be responsible for locating any beneficiary or survivor <br /> entided to benefits by or through the Agreement and any collected funds unclaimed by <br /> Owner after three years from the expiration of the Agreement may be returned to <br /> parties making payment to the City. Any remaining undeliverable funds shall inure to <br /> the benefit of the appropriate utility. <br /> In the event of the assignment or vansfer of the rights of the Owner <br /> voluntarily, involuntarily or by operation of law, then the City shall pay any benefits <br /> accruing hereunder, after notice, to such successor of the Owner as the City, in its sole <br /> judgment, deems entitled to such benefits; and in the event conflicting demands aze <br /> made upon the City for benefits accruing under this Agreement, then rhe City may at <br /> its option commence an action in interpleader joining any party claiming rights under <br /> this contract, or other parties which the City believes to be necessary or proper, and the <br /> City shall be dischazged from any liability upon paying the person or persons whom <br /> any court ha�•ing jurisdiction of such interpleader action shall determine, and in such <br /> 2�' <br /> 5 <br />
