All of the recitals set forth above are adopted by the partie� yS material <br /> elements and/or findings related to this Agreement. <br /> 2• T'hat the Owner may be reimbursed by owners of the benefited property <br /> for portions of the cost to the Owner of certain facilities, herein referred to az �he <br /> Utility installed by the Owner when such facilities aze in the future connected to such <br /> benefited praperties. <br /> 3• That the Owner has constructed or will construct a �r <br /> (Uulity — <br /> �ial of P.v.C. e inches in diameter and 355 feet in <br /> descnption) (type of pipe) � <br /> length, approved by the City, to serve the area including the Owr.er's property as <br /> described in pangraph C above and the benefited property described in Paragraph H <br /> above and as shown on Exhibit A. <br /> 4• That the Utility has been or will be constructed to meet all standards of <br /> the City Public Works Department. <br /> 5• That if Ihe Utility is certified as acceptable to the City by the Pub]ic <br /> Works Department, the Owner will convey the Utility and the easements and lands <br /> wherein it lies to the City. The City will thereafter operate the Utiliry as par[ of the <br /> City system and will chazge normal connection fees and use charges. <br /> 6• The Owner shall transfer titfe free and ciear of all encumbrances, to the <br /> Utility described in Exhibit A by a Bill of Sale to be executed and delivered by Owner <br /> to the City upon accepLZnce of said Utility for maintenance by lhe City, which <br /> instrument shall contain Owner's waaanty that it has good tifle and the ri;ht to convey <br /> said Utiliry and that it wi11 warrant and defend the City agains[ the claim of interest <br /> 3 25 <br />
