Qudden, Chief Inspector <br /> Gentlemen: <br /> Referencing Mr. Budden's letter of February 19, 1y81, please be advised <br /> that I believe you are confused in reference to the responsibility of the <br /> Testing Laboratory, be it P.E.L. or U.L. Our responsibility is to investi- <br /> gate and test the product to determine its level of safety. If a ositive <br /> test is conducted, these tests are documented in a report, a copy of w ich <br /> ycu now have in your file, or in the case of U.L. it would be the "Follow- <br /> up Service Documentation." <br /> In the specific case of the Fan Coil units for the Fluke Facility, this <br /> report defines a level of safety which in the spirit of the Codes, "protection <br /> of life, limb and property", would in our professional opinion meet these re- <br /> quirements. <br /> Once this has been addressed, we then move into an entirely different <br /> area. You, (the City of Everett) and we (Protection Engineering Laboratories) <br /> have made every �easonable effort to define the hazard, and in this case, the <br /> correction. We now come to the proposition as to whether Allied Sheet Metal <br /> Fabricators will modify these units in "Good Faith" or use the report as a <br /> "License to Steal ." In the event of failure to comply and subsequent litigation, <br /> thzir position in respect to liability becomes very tenuous. So, too, does <br /> the position of Fluke, the Owners, the Architect and the General Contractor. <br /> This same concept is applicable to any U.L. Listed product. Less than 1� are <br /> ever inspected bv the U.L. Follow-up Service. Trust must begin somewhere. <br /> As you will note in our february 15 letter to Mr. Bondi , of Allied Sheet <br /> Metal , we have just begun to address the subject of labeling. To be candid, <br /> the reason for this delay was the failure of Allied to remit in payment of <br /> our invoice of December 22, 1980, until Feburary 12, 1931. 4Je operate on a <br /> "tash" basis with reports held until remittance is made.
