Inc. , herein- <br /> � e[ter referred to as "Owner;' owns certain property w�thin the City of Everett <br /> � � legally described es follows: <br /> 1� <br /> � <br /> WHEREAS, Owner has applied for e permit from the City o[ Everett which <br /> under Ordinance No. 555-78 and Ordinance No. 665-80 require eertain improve- � <br /> ments to be made to public rights ot way es a condition to issuance of certain Cit}• <br /> permits; said Ordinences allow thnt the City Engineer may accept a covenant <br /> consenting to the tormntion of a local improvement district in lieu of having Owner <br /> construct and install the required public improvements when, in the opinion of the <br /> City Engineer, certain actual improvements ara not desirable due to known or <br /> perce[ved physicel problems or the need for more comprehensiv� improvements; <br /> 1 WHEREAS, Owner's property and the adjecent public rights of way have <br /> � been determined to require a covenant consenting to the formation ot a local <br /> s <br /> tmprovement district rather than having Owner make specific improvements. . <br /> r NOW, THEREFORE, in consideration of issuance of applicable City <br /> � permit(s) pursuant to Ordinance No. 555-78 and Ordinance No. 665-80 and in lieu <br /> jat certain public right of way im�rovements Owner consents to the formatiun of a <br /> local improvement district hereafter formed by the City or its successors or other <br /> ; prorerty owners tor the p�rblic improvement of: <br /> ji Tr lffic si�nals for Fluke Mf�., inc. entrance road at 6920 Seaway Blvd. <br /> 1 <br /> � — <br /> '# or a portion thereof including street improvements defined in Ordinance Nos. <br /> 'j 555-78 and 665-Sd to include: <br /> � <br /> '; The installation of all public tacilities required to improve the street <br /> { to City design standards including grading, drainage, pevement, <br /> � curb/gutter, sidewaik, street lighs, traffic si�naLs and other necPs- <br /> � sary appurtenances. Such street improvements shaIl not be limited to <br /> g the half street abutting the property; for example, where no per- <br /> � manent street irr�provement existed, the street improvement shall be <br /> � extended beyond the centerline a sufficient distance (10 ft. minimum) <br /> } to permit safe movement of traffic. , <br /> jThis Covenant consenting to the formation of a local improvement district <br /> �� applies (and precludes legal prote�t) only to the fornation of a local improvement <br /> district, Owner executing this document retains its, his/her or their rights under <br /> � law to provide input or to mnke objection to the scopE oC the proposed public <br /> improvements to be eccomplished by such locnl improvement district including <br /> nature and type of improvements as well ns the proposed or final benetits and <br /> ! assessment therefor. <br /> � 'Che City shall deliver a signed release ot this Covennnt to Owner after <br /> eompletion of public improvements as described hereinebove through the formotion <br /> �� of a.local improvement district and atter transmittal oC the final ns�essment role <br /> to the Cr.�tnty of Snohomish pursuant to law.
