The approval was granted based on the proposal <br /> of the Applicant as submitted io the City Planning Department. Subseguent to lhe <br /> decision, the Applicant has altered the approved design and deleted the second story <br /> as originally depicted in lhe plans. According to the City in a memo submitted to the <br /> Hearing Examiner on March 21, 2005, ihe height of the garage will actually be <br /> decreasea. <br /> Accordingly, the January 31, 2005 decision is hereby amended ar�,i approval is granted <br /> for the new design to be cons!ructed consistent with the plans that have been submitted <br /> to lhe City. Also, condition #1 (stated below) of the Hearing Examiner decision is <br /> hereby deleted. <br /> 1. A covenant acceptable to the City Atiorney's office <br /> shall be recorded on the title to the property stating that the <br /> property owner acknowledges the reauirements of this <br /> section, and stating that the use of any accessory structure <br /> is limited lo acce�sory activities permitted by the zone in <br /> which the properiy is locaied, and that the accessory <br /> buildir�g shall not be converled to living area or used for any <br /> purposes which are nol in fuil compliance with zoning and <br /> buiidinc� code requirements. <br /> Done and dated lhis 23`d day oi March, 2005. <br /> , <br /> 0 <br /> �1� �l,�ca,c�t'!�a <br /> Jam .
