Construcdon of the home we were having built was completed lhis summer. The e�cterior landacapiny and final completion oocurred this last week-end. Now that we have comp�eted everything,w�wanted to respond on the matter of the City of Everett's drainpipe ar 1 draina9e system. My written comments will be pretty much in Iine with what I discussed with you last winter. Durin9 preWous discussions with Pub�is otrcentered with n�e easement area r offioe, it became apparent that Ihe Ciry's drainage pipe Your October 1992 leuer directed to our attentlon stated that . . . • "This easement contalns a t 2"concxete drain pipe that conveys street run-ott water. Malntenance of the system is the responsibility of the City of Everett° ^As recently identiBed at your constructio,n sita,the dralnage pipe does not � appear to be centered within the easemenL" • "For everyone's records,your foundaHonlfootings are located at an elevatlon substantially below the 12"pipe, and we antidpate no tuture problem with the proximiry of the pfpe and your foundatior�" We appreciate the City's response and the City's assurance:+on malntenance as we��as the comment that PubliC Works"anticipates no fut�:re probiem,"hrnNevor�g�w e��W�hav�e a dear on the matter of Ifability. We certainly do not want to appe yreat deal of respect for the City's public works department and its employemee•C ty that an leve, however,that we must state our position. For the record,we are nodfying damape to our structure as a result ot the failure of the Ciry's drainage system will be the ity's Ii2bility. We would expecc the City to reimburse the owner for all claims as a result of any damage.
