WHEREAS,the total cost of these already committed or pending projects and programs coupled <br /> with the initial administrative and consulting costs exceed millions of dollars; and <br /> WHEREAS,the NMFS is likely to publish a federal regulation(Section 4(d)rule) in April 1999, <br /> which includes a prohibition of"take"of the listed species pursuant to Section 9 of the ESA,that <br /> will apply throughout the Puget Sound Chinook's habitat range to ensure that conservation of the <br /> listed species takes place; and <br /> WHEREAS,the City of Everett intends to offer, for consideration by NMFS, both <br /> independently and in concert with other jurisdictions in the Tri-county effort, appropriate <br /> components of its proposed early action package for inclusion as exemptions into the Section 4(d) <br /> rule. The City would make this proposal in order to provide coverage for its continuing operations <br /> and regulatory actions and thus minimize disruption to the services provided by the City to its <br /> citizens from the application of the Section 9 "no take" prohibition ,which in turn will expedite <br /> and facilitate the development of a long-term integrated recovery plan for Chinook; and <br /> WHEREAS,the City of Everett's present ordinances, plans and regulatory scheme together with <br /> its current work to develop a credible, substantive package of early actions demonstrates the <br /> City's good faith and commitment to recover Chinook; and <br /> WHEREAS,the City's proposal includes a comprehensive set of actions and projects which the <br /> City has authority to undertake for Chinook protection and recovery as a single local <br /> governmental entity; and <br /> WHEREAS,the City's proposal includes early actions for the years 1999-2000 and a series of <br /> further actions over the following two to five years; and <br /> WHEREAS,the City's proposal will be submitted to NMFS with the expectation that the <br /> agencies of the state government,the federal government and the NMFS in particular, will work <br /> in partnership with the City, Tri-county governmental and non-governmental members and other <br /> community representatives to devise an appropriate, meaningful, cost-effective and enduring <br /> strategy to promote recovery of the Chinook. <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT as follows: <br /> Section 1.Early Action Proposal as Commitment to Chinook Recovery. <br /> The proposal is offered as part of a coordinated Tri-County early response package and <br /> represents the City of Everett's proposed initial response to the listing of Puget Sound Chinook <br /> Salmon under the Endangered Species Act. It is offered prior to the anticipated listing date in <br /> order to demonstrate the City's commitment to recovery of the Chinook in Puget Sound. It is <br /> hoped and anticipated that the federal government will work in partnership with the City of <br /> Everett,Tri-County governmental and nongovernmental parties to devise an appropriate, <br /> meaningful, cost-effective and enduring strategy for recovery of the Puget Sound Chinook <br /> salmon. This proposal represents Phase I of the City's proposed response to the listing. Phase II <br /> will be developed over the next year, and will be closely coordinated with inter jurisdictional <br /> watershed planning efforts. <br /> 2 <br />
