RESOLUTION NO. 6703 A Resolution Amending Rezone Resolution No. 5382, and Amending Exhibit C of Resolution No. 5382, the Development Agreement for the Port of Everett North Marina Redevelopment Planned Development Overlay Zone, and Authorizing the Mayor to Execute the Amended Development Agreement. WHEREAS,the City Council adopted Resolution 5382 on September 17, 2003, which rezoned the Port of Everett's North Marina Redevelopment Area to W-C PDO (Waterfront Commercial - Planned Development Overlay); and WHEREAS, Rezone Resolution No. 5382 included as an exhibit a Development Agreement between the City of Everett and the Port of Everett establishing development standards and conditions for the North Marina Redevelopment Area, including regulations pertaining to maximum building height, view planes, view corridors, and design standards and guidelines; and WHEREAS,the City Council does find the following: 1. The Everett City Council approved a comprehensive plan amendment and a Planned Development Overlay (PDO) rezone in 2003 to allow the Port of Everett to develop a mixed use residential, commercial, recreational, and marine services project on property known as the North Marina Redevelopment area; and 2. The City of Everett and Port of Everett did execute a Development Agreement concerning the redevelopment of the North Marina Redevelopment area, including a conceptual site development plan and development standards that provided for a maximum building height of 55 feet for residential portions of the proposed development; and 3. Following execution of the development agreement,the Port of Everett and its development partner, Maritime Trust, entered into the detailed design phase to refine their plans for the mixed use development; and 4. Through engineering and environmental studies, the Port of Everett and Maritime Trust discovered a higher ground water table on the subject property than originally understood, causing reconsideration of project design; and
