14. The Port of Everett and Maritime Trust did provide the public story pole <br /> demonstration on October 8, 2005, and did provide responses to the request for <br /> additional information by the Planning Commission; and <br /> 15. The Planning Commission held a public hearing on October 18, 2005 to consider <br /> additional information presented by the Port of Everett, Maritime Trust and their <br /> consultants, and did consider public testimony both in opposition and in support <br /> of the proposed amendment to the development agreement; and <br /> 16. In order to approve a proposed amendment to a plan approved under the Planned <br /> Development Overlay rezone process, the City Council must find that the <br /> proposed amendment is in the best long term interests of the community; and <br /> 17. The visual impact of the increase in permitted height, in comparison to that which <br /> is allowed under the existing development agreement, though measurable, is only <br /> an incremental increase in impact to views from the Grand Avenue bluff View <br /> impacts allowed under the existing development agreement represent a greater <br /> change from existing conditions than will occur by the increase of 10 feet for <br /> residential building structures and up to an additional 10 feet for rooftop <br /> appurtenances; and <br /> 18. The open space system proposed by the proposed revised plan represents a <br /> significantly greater amount of public open space with improved pedestrian <br /> facilities over that provided in the plan approved by the 2003 development <br /> agreement. The improved quality of public open spaces proposed is made <br /> possible, in part, by placing off-street parking within enclosed structures, which is <br /> facilitated by the proposed increase in permitted building height; and <br /> 19. The parking management plan will be implemented and updated in each phase of <br /> development, with review and adjustments made by the City Engineer and <br /> Planning Director as necessary to provide for adequate public parking and parking <br /> for residents, businesses, visitors, and boaters. This approach to parking <br /> management provides for adequate parking as well as an efficient use of parking <br /> resources while minimizing aesthetic impacts of large parking lots; and <br /> 20. The Planning Commission did recommend that the City Council approve the <br /> proposed amendments to the development agreement, subject to additional <br /> conditions; and <br /> 21. The evidence in the record shows that the proposed amendments to the <br /> development agreement are in the best long term interests of the community; and <br /> WHEREAS, the City Council concludes that the amendments to the 2003 development <br /> agreement between the port of Everett and the city of Everett for the North Marina <br /> Redevelopment Area are in the best long term interests of the community. <br />
