EVERETT, W�SHINGTON <br />It is recommended that the following item be placed on the <br />City Council Agenda: <br />CONSIDER THE APPROVAL OF T:iE RIGHT-OF-WAY USE PERMIT <br />FOR THE PLACEMENT OF A PLANTER BOX ON A CITY SIDEWALK <br />AT 2718 WETMORE AVENUE <br />EXPLANATION <br />Senter and Miller, Attorneys-at-Law, have applied for permission <br />to place a planter box on the city sidewalk at 2718 Wetrnore. The <br />planter box has an ornamental 10"x16" sign attached above it. <br />The applicant has completed renovation of the existing building, <br />and to carry out their concepts, the 30" square planter box <br />would be placed on the sidewalk directly in front of their office <br />building. <br />Their request is within the normal usages of the property i.n the <br />area except that the planter will be placed agai�ist the building <br />rather than next to the curb, due to the fire hydran� which is <br />located at the curb directly in front of the bui:Lding. The side- <br />walk is 15 feet tiuide throughout the area. With �.he planter box <br />and the hydrant in the sidewalk, there is 9 feet of space remain- <br />ing for normal pedestrian requirements. <br />The planter box and foliage will be an asset in helping to beauti- <br />fy the area. <br />The placing of objects on public sidewalks is controlled under <br />the Everett City Code, Chapter 13.12, which provides that City <br />Council may authorize such objects as boxes for trees and <br />shrubs. The sign i� attached to the container as an integral <br />part and is considered not to be a"sign per se" by the Direc- <br />tor of Community Development. <br />ACTION <br />The proposal has been reviewed by the various City departments <br />and no objections or adverse effects were expressed, except <br />for the Water Department which has made their approval subject <br />to the box not being place3 over the water valve in the area. <br />The applicant has indicated that he has no objection to this <br />stipulation. <br />� <br />
