I do not think a subterranean or basement level commercial space can be a"street level commercial
space" for the purposes of Ord. 3127-09. Although you can waik down to the entrance of 2902 Wetmere, (the space
below Subway, right?) I think it is still pretty clearly a subterranean space.l i„ nk he r st oftyour assumpt oensla e Iright.
literally and applying it to spaces that begin at street level (like Subway).
Like you said, the maintenance portion of the ordinance applies to all structures regardless of the number of levels the
structure has.
Hope this heips. If you happe upon any other spaces that are questionable i=el free to give me a cali.
Thanks,
KA.Li.Pi I.A3'1.ilUN1i
City of Everett
Legal Department
2930 Wetmore Avenue, Suite 10-C
Everett, VA 98201
T: 425.257.7007
From: Meg Haley
Sent: Wednesday, February lCi, 2010 3:30 PM
To: Katie Rathbun
Cc: Kirk Broaks
Subject: Question about lower than street level space RE Ord. 3127-09
Hi Katie,
The space 2902 Wetmore Avenue is in the CBD and has been unoccupied for more than 90 days. The basement entry
and faade of the space s visible from the sidewalk, but not from a passing vehicle. Regarding the terminology of street-
level in the ordinancE, would ihis space fall under the requirements of the ordinance for window display and vacancy
registretion (or exem:ion)? 71e parcel address is 1620 Hevitt Aveue, which has four addresses listed on the City of
Everett GoSynch GIS map.
« File: WETMORE AVE 2902-091201; DETERMINE IF VACANT.jpg» « File: WETMORE AVE 2902-100101; DETERMINE
IF VACANT.jpg»
liere are my assumptions:
. GoSynch, the GIS map, typically lists addresses accessed from street level, some of which do not fall under the
ordinance.
• Second floor spaces do not fall under the ordinance, even if they are accessed from a street-level door.
. Basement floor spaces typically do not fall under the ordinance, even if they are accessed from a street-level
door.
