With the 10 foot setback requirements, the new building would be
situated, as shown by the red lines vis as vis the old building
and the remaining building. a 0
'Ova ft
Exceptional or Extraordinary Circumstances
The exceptional or extraordinary circumstances here are not
created by a cliff or other difficult physical feature to the
property. Rather the circumstances are special because of the
fact that there are 80 foot right-of-ways on 32nd. and on Wetmore
and that the application of the set back requirements deprives the
fee owner of the reasonable use of the property. Further,
practically, economicalXy and esthethically the new building is
better placed closer to the lot lines; in the same location as the
existing building.
The existing and new buildings along Wetmore between Pacific and
3th. have suburban type front yards because of the 80 foot
right-of-way. The 80 foot right-of-way in and of itself, even
without the addition of the 10 fcot set back requirement would
provide for generous distances between the street and the building
fronts. The esthetics sought by the City with the 10 foot
setbacks is achieved by their non use of a major portion of the 80
foot right-of-way. Why should the city place the burden on the
property owner for maintainances of the distances from the actual
street, as it is currently used, rather than bearing it themselves
with the unused right --of way?
If the existing building on the subject property were to remain or
be remodeled, it would stay where it is, with no space between it
and the property line. Once torn down, to make way for the
construction of a building which would provide a definate visual
improvement at a prominate intersection, we are deprived of the
use of 10 feet on each side.
In conclusion, the application of the 10 foot set back requirement
is not needed to accomplish the purpose of ample front yards with
nice landscaping. Added to the 80 foot right-of-way, the City
then has 100 feet , while the property owners' lot size is
reduced, on a corner, by 10 usuable feet in two directions. An
owner of a corner lot where there is an 80 foot right- of -way has
a greater burden to bear on than does an owner in the middle of
the block.
