The real extraordinary circumstance <br />is that the corner lot owner bears the burden with his 10 feet <br />rather than city with their unused 80 foot right of way. <br />Enjoyment of a substantial property right <br />Application of the set back requirement on Wetmore and 32nd. <br />deprives the owner of 2200 square feet out of a total of 12,000 <br />square feet. If no new building were built, and the existing <br />building left in place, left alone, or remodeled, there would be a <br />building in the same location as the new building, should I be <br />allowed this variance. Thus I am deprived of the use of 2200 feet <br />by improving the property. <br />There is a real benefit to the other property owners who have not <br />built new buildings: they can continue to use the property which <br />the City requires for a set back for new construction. They <br />possess this right; the variance is needed for me to have this <br />right preserved. <br />GRANTING OF THE VARIANCE WILL NOT BE DETRIMENTAL <br />The existing building sits on the property line, it is not <br />deterimental to the wel"are or injurious to other properties in <br />the neighborhood. There is no disruption of site lines for autos <br />going East on and. <br />Conversely, granting of the variance will be beneficial to other <br />property owners in the neighborhood. Across the street there is a <br />50 foot lot in a prime locations virtually rendered unbuildable <br />because of the set back requirements.
