Copies were mailed to the <br /> Respondent via first class and certified mail to the Respondents last known address <br /> which ECE Officer Keirsey obtained from Snohomish County Assessors Record. A <br /> copy of the citation was posted at the property. Each method of service used is <br /> independently sufficient to provide notice. (Pursuant to EMC 1.20.010.C.1) (Exhibit <br /> #4, Violation Citation dated December 31, 2013 with mail receipts) (Exhibit#5, <br /> Declaration of Service dated December 31, 2013 with photos) (Testimony of Code <br /> Enforcement Officer Keirsey) <br /> 11. On January 14, 2014, the Respondent contacted ECE Officer Keirsey and stated <br /> that she was working to clean up the property and would call for an inspection when <br /> she was done. (Testimony of Code Enforcement Officer Keirsey) <br /> 12. On January 15, 2014, ECE Officer Keirsey reinspected the property and observed <br /> and photographed that violations of the EMC remained on site. She conducted a <br /> search of the City of Everett building records and found that although there were <br /> several expired permits for work on the property and an application for the upper <br /> story deck had been submitted, no permit had been issued. The trustee sale on the <br /> property had been postponed to January 17, 2014. (Exhibit#1a-1j, Pre-Hearing <br /> Inspection Photos dated January 15, 2014) (Testimony of Code Enforcement <br /> Officer Keirsey) <br /> 13. The City provided the Respondent with an opportunity to correct the conditions that <br /> are in violation of sections of the EMC and provided a deadline date of January 15, <br /> 2014 for corrective action and provided notice of the date, time and place of this <br /> hearing. The Respondent appeared at the hearing. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br /> of Everett has jurisdictional authority to hold this hearing and to issue the decision. <br /> EMC §1.20.020 <br /> Applicable Law: <br /> 1. EMC 8.20.020, which reads: <br /> No person owning, leasing, renting, occupying or having charge or possession of <br /> any property in the city, including vacant lots, shall maintain or allow to be <br /> maintained on such property except as may be allowed by any other city ordinance <br />
