PLANNING DIRECTOR <br />DETERMINATION OF DENIAL <br />NON -CONFORMING BUILDING/USE # 95-002 <br />Applicant: Lawrence R. & Elizabeth M. Taylor (present name Beth McDonalo, <br />Address: 3409 Wetmore Ave., Everett, WA 98201 <br />Descriitlon of property structure(s) and parcel(s) being certified: <br />Site Address: 3409 Wetmore Avenue <br />Legal Description: Lot 5, BLK 821, Plat of Everett Division A <br />Tax Identification Number: 4369-821-005-0001 <br />Zoning: R-3, Multiple Family Medium Density <br />Description of non -conforming use/activity: The subject property is currently <br />developed with one single-family residence. Presently the residence is being used as a <br />duplex, with separate entrances accessing the dwelling units. <br />Current zoning for the R-3 zone requires a minimum of 1,500 square feet per dwelling <br />unit. The subject property is only 2,996.5 square feet in lot area, and therefore it fails to <br />meet current zoning standards for a duplex structure. <br />Findings: The Polk Directory records provided by the applicant do document multiple <br />persons residing at the subject property, however the address is not denoted as a <br />uplex by separate addresses (le. 3409 Wetmore and 3409'% Wetmore). Also, City <br />permit history shows the subject property as being a single-family residence. This is <br />also the case for Metroscan records, of which the information has been derived from <br />Snohomish County Assessor's records. <br />Conclusion: The subject property has not been legally used as a duplex since <br />December 1, 1956, therefore it does not meet the necessary criterion for non -conforming <br />building/use certification, and is not entitled to certification. <br />Decision: The information submitted by the applicant, demcnstrating that the residence <br />had been used as a duplex prior to December 1, 1956 up to present day, is insufficient. <br />Therefore, the use of the single-family residence as a duplex is not recognized ar legal <br />iron,--cconforr ing. <br />Date: `i /8-10D0 <br />Paul A.
