Conclusions of Law <br />The conditions as described above constitute violations of Everett Municipal Code 13.30.020, <br />19.34.060. <br />2. The property owner to date has not corrected said violations. <br />3. Pursuant to Chapter 1.20 of the Everett Municipal Code, the Violations Hearing Examiner has <br />jurisdiction over this matter and parties. <br />ORDER <br />Based on the Findings of Fact and Conclusions of Law read into the record at the February 15, 2001 hearing of <br />the above matter, the following Order is issued: <br />Peter R. McCann, Trustee or other parties of the trust including beneficiaries shall abate all violations of <br />EMC 13.30.020, 19.34.060 on the property located at 3417 Wetmore Avenue, Everett, Washington. <br />Abatement shall occur by removing vehicles from the front yard at 3417 Wetmore Avenue, Everett <br />Washington and parties shall cease from crossing the curb to park in front yard. <br />Abatement the violation(s) on said property shall be completed by February 15, 2001. <br />3. Peter R. McCann, Trustee shall not violate any of the aforementioned ordinances for the next twelve <br />(12) months. Should the city observe any violation the trust shall be fined $500.00 for each violation. <br />Appeals of the fines may be brought to the Hearing Examiner. <br />4. This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing. <br />5. if the owner fails to abate the identified violations as directed by this Order, the City of Everett is <br />authorized to undertake and complete the abatement ir. conformance with the provisions of the Everett <br />Municipal Code, Chapter 1.20, at the full expense of the owner and the City may act without further <br />order or direction of the Violations Hearing Examiner. <br />Entered this 15'h day of February 2001. <br />mes M.
