O;7hST <br />and KARLA D. QUAS: close the sale for the purchase of the remainder <br />of Lot 20 from AiLEN R. POTTER and CHERYL M. POTTER the QUASTS <br />intent to improve Lot 20 by the construction of a residence which <br />will entail excavation on Lot 20 and a pian to fence or construct <br />a retainer wall of that portion of the North line of Lot 20 that <br />they are ourchasing from the POTTERS. <br />NOW THEREFORE in order to amicably settle all claims JOHN W. <br />McCAULEY and JANE F. McCAULEY, husband and wife, as owners of Lot <br />21 and a portion of Lot 20, have against ALLEN R. POTTER and C&ERYL <br />M. POTTER and any party taking from the POTTERS, for electrical <br />line easement and agreement to maintain and service the drain-field <br />presently servicing the down-spouts of the McCAULEY property on Lot <br />21 and a portion of Lot 20 and to resolve any potential problems <br />of drainage from Lot 20 on to Lot 21 created as a result of <br />erection of the residence, fence, and or retaining wall on Lot 20. <br />IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS: <br />1. That WARREN B. QUAST and KARLA D. QUAST will �3rant an <br />electrical easement over and across Lot 20 with the terms and <br />conditions and the description as set forth in the electrical <br />easement attached hereto marked Exhibit "A", and by this reference <br />incorporated herein. <br />IT IS FURTHER agreed that WARREN B. QUEST and KARLA D. QUAST <br />will grant to JOHN W. McCAULEY and JANE F. McCAULEY a perpetual <br />fence easement with terms and conditions and description wtiich is <br />attached hereto marked Exhibit "B" and by this reference <br />C <br />
