EASEMEIVT <br />damages are caused by or result from dx concurrent �gligence of (a) the Grantor, iu agents, <br />successors or assigns, and (b) the City, iu officers, employee, or agents, this indemnity <br />provision shall be valid and enforceabie to the extent permiaed by law. The Grantor <br />s�ecifically and expresslY waives any immuniry under Industrial Insurance, Tide 51 RCW, and <br />aclrnowiedges that this waiver has been mutually negotiaud by the parties. <br />7. T6e Grantor also covenants to the City that Grantor is lawfitlly seized and possessed <br />of the land aforesaid; has a good and lawful right and power to sell and coavey same; that <br />same is free and cleaz of encumbrances, ezcept as above indicated; and that Granror will <br />forever warrant and defend the tide to said easement and the quiet possession thereof against <br />the lawful claims and demands of ail persoas tehomsoever. <br />8.
