That there have been exceptional or extraordinary circumstances or <br />conditions applyin� [o [he subject property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Finding: The applicant owns a parcel of property which is located at <br />5028 Wilmington. The applicant's property conststs of an 90' X 165" <br />Lot and is 14,850 sq. ft. with a single family residence. The property <br />is located in the R-1 zone which requires a 6 foot side yard setback. <br />The applicant is proposing to add a garage in the back yard area that <br />would be 3 feet from that property line. Most gara�es that take access <br />off alley have 0' to 3' setback. <br />Conclusion: The applicant's property does cuntain physical conditions <br />or circumstances that are unique to his property for whicli a variance <br />can be granted. Otlier property in Lhe area have garages with setbacks <br />as proposed. This does constitute a hardshtp based on the fact tha[ <br />this is the only location where a carport or gara3e could be located <br />and leave a reasonable rear yard area. <br />2. That such variance is necessary for t',� preservation and enjoyment of a <br />substantial property riglit oE the appeilant possessed by the owners oE <br />nther propectLes in [he same vicinity or zone; <br />Finding: The applicant's property [s located in an R-1 zone and is <br />being used per that requirement. There are otl�er garages tiat take <br />access oEf alleys that have similar setbacks. <br />Conclusion: Tlie garage and setback proposed would not be inconsis[ent <br />with the buildings ia tlie area. <br />
