ORDER <br />o)� ���'�5/�'� Gl�`"P�(�rry Vognild) <br />� Variance /25-84 <br />Buaed upon the written requeat for a variance from the City"e Zoning <br />:ode, epecifically E.M.C. 19.14.050(B) made by Larry Vognild of 5028 <br />i111mington, herelnafter, referred to ae the "Applicant," the Board of <br />Adjuatment, follo�ing a public hearing on said application held on September <br />10, 1984, and further having reviewed all testimony, makes [he folloving <br />FINDINGS, CONCLUSIONS AND ORDER. <br />FINDINGS AND CONCLUSIONS: <br />1, That there have been exceptionnl or extraordinary circumstances or <br />conditiona applying to the subject property or as to the in[ended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />2 <br />Finding: The applicant o�.ma a parcel of property whlch ie ocated at <br />5028 Wi1minBton• The applicant's propertq coneiata of an 90' X 165" <br />lot and ie 14,850 eq. ft. vith a eingle family residence. The property <br />is located in the R-1 zone which requires a 6 foot eide yard eetback. <br />The applicant ie propoeing to add a garage in the back yazd area that <br />vould be 3 feet from that property line. Moet garagea that take accese <br />off alley have 0' to 3' aetback. <br />Conclusion: The applicant's property does contain physical canditions <br />or circumstancee tha[ are unique to his property far ahich a variance <br />can be granted. Other property in the area have garages with setbacka <br />ae proposed. Thie does conetitute a hardahip baeed on the fact that <br />this ia the onlq location where a carport or garage could be located <br />and leave a reaeonable rear yard area• <br />That such variance ie necessary for the preservation and enjoyment of a <br />aubetantial proper[y right of the appellant possessed by the ocmers of <br />ather properties in the eame vicinity or zone; <br />Finding: The applicant's property is located in an R-1 zone and ia <br />being veed per that rzquizement. There are other garages that take <br />access off alleys that ;�ave similar aetbacks. <br />Conclusion: The garage and setback proposed would not be inconeiytent <br />with the buildings in the area. <br />3.
