9,2 Right of Entry of Association Reoresentativ�: Any <br />agent oc officer of the Aasoc,iation may at any ceasonable <br />pre-determined hour or hours upon twenty-fouc (24) �ouca' <br />notice during conetruction or extecior remodeling, entec and <br />inspect any of said property as to its mainter.ance or improve- <br />ments to determine if there has been compliance with the <br />proviaione hereof. The Association and any agent or officer <br />thereof shall not thereby be deemed guilty of any manner of <br />treapaes for such entry or inspection. <br />9.3 Evidence of ComR�iance With Aestrictions; Recorde <br />of the Association with cespect to compliance with the provi- <br />sione of this Declaration shall be conclusive evidence ae to <br />all natters shown by such records. After the expiration of six <br />(6) months following the completion of any construction, <br />addition, altecation or change to any building on a building <br />eite, in the abaence of any notice to comply or in the absence <br />of any euit to enjoin such work or to force compliance by <br />change or removal of such work within said period, then and in <br />that event said structuce work, improvement or alteration shall <br />be deemed to be in compliance with the provisions of thie <br />Declaration. <br />y • I ' I : � • • • � • �1. I <br />10.1 Vacant Lots: It is the intent of theae <br />restrictions that vacant lota be maintained in a reasonably <br />presentable condition. Therefore, the Aesociation shall have <br />the cight at all timea to enter upon any lot or building site <br />that is vacant and unplanted or untenanted by the owner, after <br />�easonable notice to the owner, to remove debris, weede or <br />other waste materisl and to trim, cut back, remove if damaged <br />or dead, cultivate and/or maintain'�edges, tceesr shruba, <br />planta or lawne and to cha�ge the expense thereoz to the owner <br />ae an asseasment. The Aeaociation shall have the righte with <br />respect to such assesament as set forth in Acticle VI as to <br />annual and special a�.eesamente. <br />10.2 Owner's Obligation to Maintain Plantina: Where <br />the Association has pecmitted an ownec to plant a portion of <br />the Common Properties ahutting the owner'e propecty in accor- <br />dance with the owner's landscaping design, the owner shall <br />thenceforth be obligated to maintain at his own expense such <br />planting. Failure of the owner to maintain the landscaping of <br />euch portion of the Common Properties or parking bays thereon <br />shall give `.he Aesociation a right upon reasonable notice to <br />the ownec to maintain such areas of the Common Propertiea and <br />to charge the expense thereof to the owner as an assesament to <br />be collected in the mannec provided in Article VI. <br />10.3 Reasonable Notice: "Reasonable notice", ae that <br />term ie uaed in this Article, shall mean mailing by certified <br />mail to the last known addresa of the owner shown on the booke <br />of the Aasociation not less than ten (10) daye before entry on <br />such owne�'s property is made or maintenance of such landscap- <br />ing,ie undertaken pursuant to Section 10.2. <br />., . .,: . . �- -, <br />Nothing contained in this Declaration shall be <br />conetrued to prevent the erection or maintenance by Declarant <br />- 12 - <br />
