<br />Washington. (hereinafter referred to as Parcel II.)
<br />their heirs, succesaors and assigns, and is 1�ereUy declared to be a;covenanC
<br />running with the land.
<br />Said easement is granted upon the following terms and conditions, wliicli Uy the
<br />present owners of Parcel B afEixing their slgnatures to this document agree tl�at
<br />said conditions shall be Uinding upon the present and future owners of the above
<br />described Parcel B, their lieirs, successors and assigns.
<br />(A) That in the exercise of the rights herein conveyed to the present and
<br />future owners of Parcel B, the owners oF Parcel'B, for themselves, tlieir
<br />heirs, auccessors and assigns agree that they shall restore the "easement
<br />area" herein described to the condition said easement area �aas prior to the
<br />exercise.of any of the rights lierein granted, at their cosl- and expenFP; and
<br />in tl�e event of failure to do so witliin tl�irty (30) days after demand is
<br />made by tl�e owner of Parcel A, the owner of Parcel A sl�all t�ave the right
<br />to restore oaid area to auch conditions, and chnrge the owners of Parce B
<br />all costs incurred by said owner ot Parcel A in�accompllshing such restoraCion,
<br />said costs to include reasonable attorneys fees and court cosCs if suit would
<br />be necessary by the owner of Parcel A to collect said costs from the owner
<br />of Parcel II, and tl�e owner of Parcel A sliould prevail in said action.
<br />(b) That the owner o[ Parcel A r.hall not be reaponsible to the owner of.
<br />Par.cel B for injurier. incurred Uy said owner of Yarcel D, or L'heir duly
<br />constituted agenLs, n, independent contracts or their employees, suUconttactors
<br />or their employees, incurred by such individuals upon the premises lierein
<br />descriUed as the "easement area" in their exercise of the ri�hts hercin con-
<br />ferred, unless such occurance was the direct result oC Che ne�ligence of tlie
<br />owner ot Parcel A, or his/8er duyl consl'iCuted agent or agents.
