<br />GARY S. .TESSOP and LOR6TTA A. JESSOA husband and wife, the owner•e of tlie following
<br />described real property situate in the County of Snohomish, Statc of Washington,
<br />to-wit:
<br />Lot 8, Larimer Ridge, according to the plat tliereof xecorded in Volume 47 of
<br />Plats, pages 112 through 115, inclusive, records of Snohomish County, Washington.
<br />(hereinafter described as Parcel A).
<br />do for in consideration of the mutual bcnefits to be derived rhe�efrom do hereby
<br />srant, convey, establish, declare and create an easement for the placemenl, main-
<br />tenance, construction, reconstruction, repair and upkeep of a sewer line, over,
<br />under, along and across a strip of land ten (10) Feet in width five feet on each `
<br />side ot a principal center line said center line beine described as follows:
<br />IIeginning at [he most Southerly cotner of Lot 9, Larimer Ridge, according
<br />to the plat thereof recorded in Volume 47 of Plats, page 112, through 115
<br />inclusive, records oE Snohomish County Washington; thence Nortli 45°4G'48" East,
<br />along said southerly llne of said lot 9 a distance of 8:� feet, to [hc true
<br />point of beginning of eaid Center line; thence Southea:;terly to intersact the
<br />most Southernline oE Parcel A, at a point /21 feet from the most Southuesterly
<br />corner of said Parcel A as measured along the South lin.. of said Parcel A, and
<br />the terminus of said center line.
<br />Together witli the right of ingress and egress, over, under, along aud across said
<br />easement area described herein for the purposes of re�,air, replacement, construction,
<br />reconstruction, maintenance, and upkeep of said "easement area". Said easement is
<br />appurtenant to and for the present and future owners of the tollowing described
<br />real property situate in the County of Snohomish, State of Washington, to-wit:
<br />Lot 9, Larimer Ridge, according to the plat thereof recorded in Volume 47
<br />of Plats, pages 112 through 115 inclusive, records of Snohomisl� County,
<br />Washington. (liereinafter referred to as Parcel B.)
<br />Cheir heirs, successors and nssi�ns, and i� hereby declared to be a:covenant
<br />running with the land.
<br />Said easement is granted upon the following terms and conditions, which by the
<br />presen[ owners of Parcel B af`ixing their signaGures to this document agree that
<br />said conditions shall be binding upon the present and Euture owners oE the aUove
<br />described Parcel B, their heirs, successors and assigns.
<br />(A) Tliat in the exercise of the rights herein conveyed to the present and
<br />fulure owners of Parcel B, the owners of Parcel'B, for themselves, their
<br />heirs, successors and assi�ns agree that they shall restore the "easement
<br />area" herein descubed to the condition said easement area was prior to Che
<br />exercise of any of the rights herein granted, sc their cost and expr_nse, and
<br />in the event of failure to do so within thir'�y (30) days after demand is
<br />made by the owner of Parcel A, the owner of Parcel A shall l�ave the right
<br />to restore said area to auch conditiona, and charge the owners of Parce R
<br />all costs incurred Uy said owner of Parcel A in�accomplishing such restoration,
<br />said costs to include reasonable attorneys fees and court costs if suit would
<br />be necessary by the owner of Parcel A to collect said costs from the owner
<br />of Parcel II, and tl�e owner of Parcel A should prevail in said acCion.
<br />(b) That the owner of Parcel A shall not be reaponsible to the owner of.
<br />Parcel D for injuries incurred by said owner of Parcel II, or their duly
<br />constituted agents, or independent contracts or their employees, suUconcr.�ctors
<br />or their employees, incurred by such individuals upon the premises herein
<br />descriUed as the "easement area" in their exercise of the rights hercin con-
<br />ferred, unless such occurance was the direct result of the negligence of clic
<br />owner of Parcel A, or his/lier duyl constituted agent or agents.
