. ,�- .__ �, �:h. _ <br /> PLANNING DIRECTOR DETERMINATION <br /> Review Proceas II t99-033 <br /> INTRODUCTION: The City of Everett Planning Department has received an application from Connie Glover, <br /> 2101 Wetmore Ave, Everett, WA 98201, to demolish an existing 18'X 20'garage and build a new 20'X 24'garage <br /> replacement. The proposeC garage would have a sethack of only 2 feet from the south side propeRy line. The <br /> existing garage structure'has zero setback from the south side property line. Section 38.040 allows for the <br /> Planning Director to allow for the expansion of a structure which dces not meet required setbacks, provided that <br /> the expansion does not make the setback rnora nonconfortning; that the expansion complies with all other <br /> requirements of the zoning code ordinance; and that the nonconformity has been certified by the Planning <br /> Department. <br /> BACKGROUND: The prope�ty is located in the R-2, Single Family Residen6al Zone. The required setback is 5' <br /> from an interior side property line for a single family residence and accessory structu�es. There is an existlng <br /> garage accessory shucture on the site. The garage building is 18' wide by 20' deep and 360 sq.ft, in area. It is <br /> located on the south side property with zero setback. This structure was built in 1924 accobing to Snohomish <br /> Caunty Assessor's Records. This structure is considered legal non-confortning or'grandfathered" as it predates <br /> the Ciry's zoning code requirement for shuctures to have a minimum setback of 5 feet from a side properry line. <br /> The applicant proposes to demolish the existing garage and replace it with a new 22' wide by 24' deep garage. <br /> The new structure will have a 2' setback from the south side property line rather than a zero setback as the <br /> existing garage. It wiil be limited to a maximum height of 15'. <br /> FINDINGS: The existing garage has been certified as le�al nonconforming related to seffiacks(NCB #99-027). <br /> The applicant proposes to demolish the exis6ng structure and replace it with a new larger structure. The new <br /> structure will have a 2' setback from the side property line and will not create any further non-confortnities than <br /> presently exists. <br /> DECISION: The Planning Director has detertnined to allow for the proposed 22'wide by 24' deep garage building <br /> with a 2'setback from the south side property line with the following condition: <br /> • Necessary building pertnits are to be obtained by the applicant from the Ciry of Everett's Building Department. <br /> Right to Appeal: The applicant or an owner of property located adjacent to the subject property may appeal the <br /> Planning Director's detertnination as to whether or not the proposal should be permitted. Any such appeal must be <br /> filed within fourteen (14) calendar days of the date specifled below. Appeal fortns are available from the Planning <br /> Department ard must be submitted along with the required filing fee.
