GRI�VANCES: <br /> As a neighboring property,we are being encroached upon by the violation <br /> of the side setback requirements of the code that these particular development <br /> standards are intended to protect against. These violations impact the standard of <br /> our living environment. The aesthetic quality of the manmade environment <br /> within our living environment has been compromised by construction of over- <br /> height and neighbor-crowding swctures. The setback violation of the deck <br /> allows invasion of our privacy by canceling the screening effect of our fence. The <br /> lack of accountability of the builder to be held to the law in his building Qrojects, <br /> both permitted and un-permitted, has resalted in an environment of intimidation <br /> and conflict with bolh adjoining properties,affecting the use and enjoyment of <br /> our properties. The builder is continuing his history of constructing code- <br /> violating structures that encroach on his neighbors and then attempung to bully <br /> his neighbors into accepting these conditions through conflict necessitating <br /> professional legal representation. It is our belief that had the builder been held <br /> accountTble for his acknowledged code violations, the builder would not have <br /> bcen encouraged to initiate litigation involving the same property line al issue in <br /> his current encroaching project. The calculated intent of the builder to violate the <br /> c«le and the hitherto for success of his arUtices of deception have encouraged <br /> disregard for other laws and disrespect of othcr governmental bodies,having <br /> spilled over as abuses in superior court that we are still in litigation to resolve. <br /> Thc decision and its subsequent lack of accountability to hold the builder <br /> resEwnsible for his acknowledged violations of code have created a separate class <br /> of citizen for which the laws of our society do not appeer to apply.
