�BIEVANCFS• As a neighboring property,we are being encroached upon by the violation of the side setback requirements of the code that these particular development standards are intended to protect against. These violations impact the standard of our living environment. The aesthetic quality of the manmade environment within our living environment has beeu compromised by construction of over- height and neighbor-crowding structures. The setback violation of the deck allows invasion of our privacy by canceli�g the screening effect of our fence. The lack of accountability of the builder to be held to the law in his building projects, both permitted and un-permitted, has resulted in an environment of intimidation and conflict with both adjoining properties, affecting the use and enjoyment of our propeRies. The builder is continuing his history of constructing code- violating structures that encroach on his neighbors and then attempting to bully his neighbors into accepting these conditions through conflict necessitating professionaf legal representation. It is our belief that had the builder been held accountable for his acknowledged code violations,the builder would not have been encouraged to initiate litigation involving the same property line at issue in his current encroaching projecL The calculated intent of the builder to violate the caie and thc hitherto for success of his artifices of deception have encouraged disregard for other laws and disrespect of other governmental bodies, having spilled over as abuses in superior court that we are still in litigation to resolve. The decision and its subsequent lack of accountability to hold the b�iilder responsible for his acknowledged violations of code have created a separate class of citizen for which the laws of our society do not appear to apply. We, as well 1s the builder's other adjoining neighbors, have paid multiple costs as a result.
