. < < � ���o�� � <br /> CO �� MAR 1 1 2002 <br /> CONFORMED COPY <br /> 200203070136 .:."........ . . .. <br /> 03/0?/2�0[ 09:44 AM Snohomi�h ervices <br /> P.0006 HECORDED County <br /> , _ <br /> ORDINANCE N0. 255a-ol <br /> AN ORDINANCE providing for the vacation of Sound <br /> Avenue lying North of Shore Avenue <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5056 duly � <br /> adopt and fix tne 11fh day of July, 2001 at 8:30A.M., as the date of public hearir.g; and � <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> anc' <br /> WHEREAS, the City Council finds it would not vacate the right-of- way if a utility <br /> easement and a view corridor easement could not be retained; and <br /> WHEREAS, the petitianers applied for said right of way vacation prior to the City of <br /> Everett's adoption of F;eso!ui+on No. 5083 amending the compensation requirements <br /> for right of way vacations; and <br /> WHEREAS, it now appears to the City Ceuncil of the City of Everett that the said right- <br /> of-way resolved to be vacated should be vacated pursuant to the terms and conditions <br /> of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> at t. e ollowing described right-of-way: <br /> All that portion of Sound Avenue right of way, as platted, and abutting Lot 16, Block 9, <br /> Plat of Shore Acres, according to the plat thereof, recorded in Volume 8 of Plats, Page <br /> 32, records of Snohomish �ounty, Washington; described as follows: <br /> BEGINN�NG at the Northeast comer of Lot 1, Plat of Edgewater, <br /> according to the plat thereof, recorded in Volume 10 of Plats, Page 94, <br /> records of Snohomish County, Washington; THENCE, Nottheasterly to <br /> the Northwest comer of said Lot 16, Block 9, Plat of Shore Acres; <br /> THENCE, South along the West line of said Lot 16, said line also being <br /> the East right of way line of said Sound Avenue, to the Southwest comer <br /> thereof; THENCE, Southwesterly along the Southwesterly projected South <br /> line of said Lot 16 to intersect the East line of said Lot 1, Plat of <br /> Edgewater, said line also being the West right of way line of said Sound <br /> /4 <br />
