/ <br /> PLANNING DIRECTOR DECISION "'' <br /> Review Process I #01-029 .�':.J.�:'.�i'"'. <br /> August 6, 2001 <br /> The City of Everett Planning Department grants approval of a request by Pacific <br /> Environmental Services to eliminate the required ten-foot wide landscape strip along Smith <br /> Avenue with the follow�ng conditions: <br /> 1. Provide landscaping as shown on the landscape plan submitted on July 17, 2001 and <br /> revised and approved on August 6, 2001. <br /> 2. The fire hydrant on the corner of 38'h and Smith Avenue shall remain visible and <br /> accessible, with a three-foot minimum clearance around it. <br /> The Planning Director approved the landscape modification based on the following: <br /> The subject property is an existing gasoline service station located at 3729 Smith Avenue. <br /> Subsection 35.030.B of the City of Everett Zoning Coda requires all sites to be brought into <br /> conformance with the current landscape standards when improvement costs exceed 35% of <br /> the assessed value of the existing structures on site. Pacific Environmental Services will be <br /> replacing the existing canopies covering the fuel islano's at a cost of approximately $20,000. <br /> The assessed value of the existing structures is $28,100. <br /> The subject property is zoned C-2, Heavy Commercial-l.ight Industry. Landscape Category B <br /> applies in the C-2 zone. Lahdscape Category B requires a ten-foot wide landscaped strip <br /> along Smith Avenue and 38 Street and a five-foot wide landscaped stnp along the north <br /> property line. No landscaping is required along the alley. Subsection 35.070.A. of the City of <br /> Everett Zoning Code gives the Planning Director, using Review Process I, the authority to <br /> modify the required landscaping if the applicant prcposes an altemative method of <br /> landscaping that would achieve the intent and purpose o� the landscaping required. Review <br /> Process I is a written decision by the Planning Director which approves, disapproves, or <br /> approves with conditions the proposal of the applicant (Section 42.090). The applicant is <br /> unable to provide the required ten-foot wide lar.dscape strip along Smith Avenue because of <br /> the existing spill containment area of _.ie fueling island and a six-foot wide substandard <br /> sidewalk. Therefore, the applicant proposed to provide the required trees along the alley <br /> rather than Smith Avenue. <br /> The a�plicant may appeal the Planning Director's decision within 14 days of the date of this <br /> letter. Appeal forms are available from the Planning Department and must be submitted <br /> along with the required filing fee.
