In order to get permits for that structure, Lameroux received <br />a waiver from Council to extend interim street improvements farther to the <br />West. Lameroux's permit was issued without "specific" requirement for drainagn <br />facilities and n�ne were insWlled. Our Permit instructions requiring inspection <br />were not complied with. <br />The Lameroux site is experiencing major ground faulting as a res_.It of improp�er <br />on-site fill. <br />On the South side of Sound Avenue lies a 40 acre unplatted , undeveloped site <br />owned by Mark Benz. Last year this site was clear-cut without any approvals <br />from the City (including S.E.P.A., temporary erosion control and unculverted <br />driveway access). <br />There currently is water running acrass Sound Avenue in two (2) spots - both <br />spots are from the Mark Benz site and directly related to the clear-cut and illegally, <br />improperly constructed access. <br />The drainage on the street is causing severe access problems for Lameroux <br />and erosion for other new construction East of Lameroux. The drainage � <br />be co�t: ibuting to some portion of the Lameroux ground faulting. <br />To correct the drainage problem, the drainage from the Benz site must be controlled <br />and the drainage across the Right-of-Way must be culverted. <br />Alternatives• <br />1. Require Mark Benz to correct on-site drainage and install culvert across <br />Right-Of-Way. <br />2. Require Lameroux to culvert across Public Right-of-Way. <br />3. City to assume responsibility of Right-of-Way culvert based on "sketchy" <br />permit requirement for proper drainage. <br />4. City to take position that Mark Benz is in violation of codes and let (or <br />encourage) Lameroux to take action against Benz. <br />� S.
