Gehret <br />5005 Sperry Lane <br />Everett, WA <br />hereinafter referred to as "Applicant," fcc a variance from E.M.C. <br />19.12.050(C) to allor: <br />a rear yard of 10 feet instead of the 25 feet required in the R-S, <br />Single Family Suburban Residential Zone. <br />on the following described proparty <br />Lot 12, Kenilworth Hills Div. 5 <br />The Board of Adjustment, following a public hearing on said application held <br />on Aoril 6, 7�87 and further having reviewed all testimony, makes the <br />folloxing Findings, Conclusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have been exceptional or extraordinary circumstances or <br />conditions applying to the subject property or as to the intended use <br />tharesf that do not apply generally to other properties in the sane <br />vicinity or zone. <br />Finding: Lot 12 is on tha northwest corner of Kenilworth Place, a <br />cul-de-sac, and 23rd Avenue N. Since the length of Lot 12 is <br />parallel to Kenilworth Place, the Zoning Code defines the easterly 25 <br />feet of the lot abutting 23rd Avenue N. as the front yard, and the <br />westerly 25 feet of : lot, abutting Lot 11, ae the rear yard. The <br />rest of the lots on Kenilworth Place front on that street, so in <br />order to eonform to other developments on this street, the <br />applicant's home should also front toWards KenilworCh Place and the <br />plans have been designed accordingly. <br />The applicant purchased the lot because it would accommodate a larger <br />rambler oriented to the south, and had house plans prepared <br />accordingly whieh cannot be implemented if the house is reoriented to <br />the east (i.e., facing 23rd Avenue W.), or iF the appllcant is <br />required to meet the rear yard seback of 25 feet. The proposed site <br />plan meets all other yard requirements. Further more, if the house <br />is situated on the site as proposed by the applicant, in effect its <br />10-foot rear yard will abut the side yard of Lot 11, KenilWorth <br />Hills, to the uest, and its ample 20-foot side yard will abut the <br />rear yard of Lot 11, Granada Seaview Estates, to the north. <br />Conclusion: The variance as proposed by the Applicant appears to be <br />a reasonable request. <br />
