PORT OF EVERETT <br />UNION SLOUGH MARSH MTI'[GATION <br />ARTICLE 17 - MISCELLANEOUS <br />SECTION 00700 <br />GENERAL CONDITIONS <br />17.1 Whenever any provision of the Conuact Docurtients requites the giving of written notice it shall <br />be damod to have been validly given if delivercd in pason to the individual or to a member of the <br />5�m or ro an officer of the wtporation for whom it is intended, or if delivered at or sent by registered <br />or certified mail, postage prepaid, to the last business address Imown to the giv« of the notice. <br />.��� � � u. <br />17.2 When any period of time is referred to in the Contract Documenu by days, it shall be computed <br />to exclude the 5rst and include the last day of such period. lf the last day of any such period falls on a <br />+stun+ay or Sunday or on a day msde a kgal holiday by the hw of the applicabk juriadicdon, such <br />day shall be omined from the computation. <br />C ��A <br />17.3 Should PORT or CONTRACTOR su�'er injury or damage to his person or propercy because of <br />any error, omission or act of the other porty or of any of the ottier party's emQloyas or agents or <br />others for whose acts the other party is kgally liabk, claim shall be mede in writing to the other party <br />within a reasonabk time of the fast observance of such injury or damage. <br />17.4 The duties and obligations irt�posed by these General Condidons and the righu atM reme�ies <br />availabk hereunder ro the parties hereto, and, in pazticular but without limitadon, the wacranties, <br />guarantas and obligations irt�osed upon CONCRACTOR by paragraphs 6.30, 13.1, 13.11, 13.14, <br />14.3 and 15.2 and all of the rights and rort►edies availabk to PORT and ENGINEER thereunder, shall <br />be in addition to, and shall not be consuued in any way as a lirtntation of, any rights and remedies <br />availabk to any or all of them which aze otherwise 'unposed or available by law or contract, by special <br />wazranty or guarantee or by ott�er provisions of the Conaact Documents, and the provisions of this <br />paragraph shall be as effecave as if repeated spxi5cally in the Contract Documents in connecdon <br />with cach particular duty, obligation, right and nmedy to which they apply.
