CI <br />FINDINGS AND CONCLUSIONS: <br />r <br />Crlterion No. 1: <br />at tTfi�Tie var�ance is necessary because of exceptionai or extraordinary <br />circumstances regarding the size, shape, topography, or location of the <br />subject property; or the location of a pre-existing improvement on the <br />subject property that conformed to the zoning code in effect when the <br />improvement was constructed. <br />a. �Fin�din �s: Thc applicant states that the variance is needed <br />ecb ause ofthe e�:sting lot shape created by tb: construction <br />of Interstate M5. <br />The Ciry finds that the subject parcel has exceptional or <br />extraordinary circumstances based upon the foilowing; <br />. l it is a small lot with a total area of only 3,072 sq.ft.; <br />b) it is triangular in shape with the deepest portion of the lot <br />measuring only 54 feet in depth along the soud� property <br />line then tapering down to a depth of only 17 feet at the <br />north property line of the site. <br />c) Once the standard zoning code setbacks of 20 feet from <br />the front and rear properry lines and 5 foot setbacks from <br />the side properry lines is applied to the subject properry, <br />only a very shallow and unusable building site is left. <br />This resultant building site is triangular in shape and <br />measures 10 feet at its deepest portion along the south <br />setback line tapering down to zero at the north providing <br />a maximum building footprint of 115 sq.ft <br />The subject parcel has been certified as a legal non- <br />conforming lot (REVIHOI-005) by the City of Everei.. <br />b. Conclusions:. The subject properry has exceptional <br />cvcumstances because it is a site that is triangular in shape <br />rather than the typical rectangular lot configuration. It is <br />very limited in lot depth dimensions as well as overall lot <br />area. An application of the stanJard zoning setbacks would <br />result in only a 115 sq.ft. building site. <br />Criterion No. 2: <br />That the var�ance w��� not be materially detrimental to the property in the <br />area of the subject property or to the City as a whole. <br />a. �Findin�gs���:. The applicant states that the proposed use "single <br />am�f �ly residential" is consistent to the other uses in the <br />immediate area. <br />The area is predominantly developed with single family <br />residences with the exception of a church and its parking <br />area just south of the subjec[ site. /;� <br />` �) <br />
