The ciry took into consideration in the Fence Height Modification deci;;ion the fact <br />that the Heard's did not build the 6-foot tall L'ence in the front yazd setback area <br />and that the fence had existed there for a number of years, <br />3. The Heard's rear-yard setback is approximately 27 feec verses a side-yam' af <br />approzimately 55 feet. Maintaining the 6-foot high feace in the side yazd will <br />allow the Heard's to continue to use this area as their active recreation spac�:. <br />4. The neighbors fence adjacent to the Heard's is 6 fect in heig6t and meets all cc�de <br />requirements as it is located in the neighbors rear-yard as the neighbors house is on <br />a corner lot oriented to 50°i Street SW. <br />5,6 +7. The fenced side-yazd dces provide a safe place for kids to play. <br />8+9. The area has recently becn signed for "No Parking" which has eliminxted people <br />pazking along the Heard's fence on the Sunset Lane frontage. This has made this <br />a much safer area for kids to walk <br />10+ 11. Mr. Heard contends that there is clear vision from both sides (of the driveway?) <br />and the neighbors have indicated ehat there have not been any accidents as a result <br />of the fence. The Public Works Department disagrees with Mr. Heard's <br />contention that there is a clear view as peop�e are backing out of his driveway into <br />Sunset I�ane. Based on the Pubtic Works Department concerns the planning <br />Direccor's decision on of the Fence Height Modification required that a vision <br />triangle must Ue provided. 1'he specific language from Review Process II p00-014 <br />is highlighted under Description of Fence Height Modification above. <br />The Heard's appea( is based on the fact that they feel that this vision triangle is <br />unnecessary and that there is clear vision from boch sides.
