EMC 39.070.A.1 grants the Planning Director the ability to pertnit a fence to exceed the maximum allowable height oi 42 inches, if approved using Review Process II. Mr. Heard was granted the fence height modification (Review Process II #00-014) with the following condition: A vision triangle must be created on site in order to provide a safe sight distance for pedestrian and vehicle operators. In order to accomplish this, a portion o/ the existing fence must be relocated. This vision friangle must be created by removing a 15-foot section of fence along both the driveway and the street frontage. The fence can then be connected together by installing a fence on the diagonal that would connect the two points at which the fence was removed. The Heards have appealed the Ciry's decision to require the creation of the �iboe•e described vision triangle.
