FINDIN(i3 AND DECISION
OF THE HEARING EXAMINER OF THE
CITY OF EVERETT
IN THE MATTER OF THE APPEAL OF
RICHARD HEARD (Review Process II
#00-014) APPEAL #00-011
DECISION: The appal of Richard Heard is panted.
The hnce helght modiflcaUon is allowed,
however, the condition requlrod by the City
of Everett for a vision triangle Is delebd.
INTRODUCTION
Richard Heard, 5006 Sunset Lane, Everett, Washington (Appellant) requested
approval from the City of Everett of a fence height modification to preserve an
existing six foot high fence within a front yard setback at 5006 Sunset Lane,
Everett, Washington (subject property). The Everett Planning Department
Director approved the fence height modfication but imposed a condition of
approval:
A vision triangle must be created on si4e in order to ,;rcvid a
safe sight distance for pedestrian and vehicle operators. In
order to accomplish this, a portion of the existing fence must
be relocated. This vision triangle must be created by
removing a 15-foot section of fence along both the driveway
and the street frontage. The fence can then be connected
together by installing a fence on the diagonal that would
connect the two points at which the fence was removed.
The Appellant appealed the condition. A hearing on the appeal was held before
the Hearing Examiner of the City of Everett on November 16, 2000. At the
hearing the following presented testimony and evidence:
Gerry Ervine, City of Everett Planning Department
Kirk Brooks, City of Everett Public Works Department
Richard Hearc!
5006 Sunset Lane
Everett, WA 98203
