A visio� triangle must be created on site in order to <br />provide a safe sight distence for pedestrian and <br />vehiGe operators. In order to accomplish this, a <br />portion of the existing fence must be relocated. This <br />vision triangle must be created by removing a 15-foot <br />section of fence along both the driveway and the <br />street frontage. The fence can then be connected <br />together by instelling a fence on the diagonal that <br />would connect the two points at which the fenoe was <br />removed. <br />(exhibRs 1 & 3) <br />4. The fence had been orected for eight years and during that Hme no <br />complaints had been filed with the City with regarci to the height of the <br />fence. Only after the Appellant moved into the home at the subject <br />property was a complaint filed. (Heard tesh,'mo��y, Ervine testimony) <br />5. The subject property is located on SunQ,et Lane on the s�::!!�west side af <br />the intersection of Sunset Lane and 5f�th Street S.W. Immedietely north <br />of the propeRy is the View Ridge Elementary School. (exhibit 2, Hearl <br />testimony) <br />6. The City, upon review of the complaint, determined that the fence could <br />remain as constructed but that a vision triengle would be required at the <br />southeast comer of the fence. The vision triangle would necessitate the <br />removal of a portion of the existing fenoe and the creation of a t�iangle <br />that would be approximately 110 square feet in area. The purpose of the <br />vision triangle, as testified to by the City, was to ensure that treffic along <br />Sunset Lane is able to see any cars leaving the driveway of the subject <br />property. (Ervine testimony, Brooks testimony) <br />Since the fence has been erected, there have been no recorded <br />accidents of any vehicles leaving the subject property. (Brooks <br />testimony) <br />8. The Appellant submitted photographs depicting traffic conditions on <br />Sunset Lane. With the limited amount of tra(fic on Sunset Lane, there <br />appears to be no immediate threat from vehicles leaving the subject <br />property. Any traffic view obstructions that are created by parked <br />vehiGes are from vehicles of parents and others picking up children at <br />View Ridge Elementary School.
