A vision triangle must be created on site in order to <br />provide a safe sight distance for pedestrian and <br />vehicle operators. In order to 7ccomplish this, a <br />portion of the existing fence must be relocated. This <br />vision trianyle must be created by removing a 15-foot <br />section of fence along both the driveway and the <br />street frontage. The fence can then be connected <br />together by installing a fence an the diagonal that <br />would connect the two points at which the fence was <br />removed. <br />(exhibits 1 & 3) <br />4. The fence had been erected for eight years and during that time no <br />complaints had been filed :�ith the City with regarcl to the height of the <br />fence. Only after the Appellant moved into the home at the subject <br />property was a complaint filed. (Heard testimony, Ervine iestimony) <br />5. The subject property is located on Sunset Lane on the southwest side of <br />the intersection of Sunset Lane and 50th Street S.W. Immediately north <br />of the property is the View Ridge Elementary School. (exhibit 2, Heard <br />testimony) <br />6. The City, upon review of the complaint, detertnined that the fence could <br />remain as ^onstructed but that a vision triangle would be required at the <br />southeast comer of th:3 tence. The vision triangle would necessitate the <br />removal of a portion of tiie existing fence and the creation of a triangle <br />that would be approximately 110 square feet in area. The purpose of the <br />vision triangle, as tesSified to by the Ciry, was �o ensure that traffic along <br />Sunset Lane is able fo see any cars leaving the driveway of the subject <br />property. (Enrine testimony, Brooks testimony) <br />7. Since the fence has been erected, there have been no recorded <br />accidents of any vehicles leaving the subject property. (Brooks <br />testimony) <br />8. The Appellant sub�nitted photographs depicting traffic conditions on <br />Sunset Lane. With the limited amount of traffic on Sunset Lane, there <br />appears to be no ir�mediate threat from vehicles leaving the subject <br />property. Any traffic view obstructions that are created by parked <br />vehicles are from venicles of parents and others picking up children at <br />View Ridge Elementary School. (Hearci testimony) <br />
