� <br />PLANNING DIRECTOR DETERMINATION <br />Expanston of Non�conforming Building Setback <br />Revlew Prooess II *00-0OB <br />INTRODUCTION: The Cily of Everett Planning Department has received an applicatbn from David <br />Eggold, 328 Tamarack Avenue, Everett, WA 98203, to expand an exisHng 18' X 24' gerage with <br />breezeway, to a new dimension of 18' X 34'. The expansion would consist of an improved roof and <br />breezeway. The expans'an would aiso indude the increase in height of the accessory building from <br />8' 6" to 14' 6'. The existing garage structure has zero setbadc irom the side property Nne. The <br />expansion would continue to the north and south along this zero setbadc line. Sectlon 38.040 allows <br />for the Planning Director to allow for the expansfon of a shudwa which does not meet required <br />setbadcs, provided that the expansion does not make the setbadc more nonconfortning; that the <br />expansion compiies with a�l other requirements of the zoning ordinance; and that the nonconfortnUy <br />has been certified by the Planning Department <br />BACKGROUND: The proQerty is located in the R-2, Single Family Detached Medium Density Zone. <br />The required setback is 5 from a side pn�perty Iine for sfngle famNy residenoes and any accessory <br />structures. There is an existing �arage/axessory structure on th9 site. The garage buildt��g is 18' <br />wide by 24' deep and 432sq.ft. m area. It is located on the eastem property lined. Aocording to <br />Snohomish County Assessors Records this structure was buflt prior to December 1, 1956. This <br />structure is considered legal non�o�fortning or `grandfathered" as it predates the City's zoning code <br />requfrement for structures to have a minimum setbadc of frve feet (5') from the side property line. The <br />upplicant proposes to make an addftion of 10' to the exisUng garage, and rafse the roof to a new <br />height of 14' 6". The new structure will have zero setback from the east side property line, consistent <br />with the existing structufe. <br />FINDINGS: The existing garage has been certified as legal nonconfortning related to setbacks (NCB <br />#00-007). The applicant proposes to make an addkion of 10' along the eastem side of the exisUng <br />garage and raise the height to 14' 6". The new structure will have zero setback from the side property <br />line and will not create any further non-confortnities than presently exists. <br />DECISION: The Planning Director has detertnined to allow for the prope�ed addition to the existing <br />garage w�sth zero setback from the side (east) property line wkh the following condkions: <br />• Necessary building pertnits are to be obtained by the applicant from the City of Everett's Building <br />Department. <br />• The uniform Building Code requires a 1-hour fire resistive constn�ction and A wall for construdion <br />within 3' of the property line. <br />• The maximum height of any detached accessory structure is fifteen (15') feet. <br />
