Construction or substantial progress toward construction of a project <br />must be undertaken within 2 years after final approval of the permit, <br />and completed within 5 years. If the project has not been completed <br />within 5 years. If the project has not been completed in this time <br />span the permit will be reviewed by the Planning Department who will do <br />one of the following: <br />- extend the permit for one year, or <br />- tenainate the permit <br />6. In 1989, the City of Everett and the Port of Everett jointly completed <br />and adopted the "Everett Harbor Front Public Access Plan." This plan <br />was intended to provide the basis for off -site public access <br />development within the context of Everett's Shoreline Master Program. <br />An part of this plan, the Port Commission has allocated 2% of final <br />costs of each capital improvement project toward development of public <br />access as defined in this plan. Prior to the issuance of building <br />permits, the Port of Everett must submit a Letter of Commitment for <br />undertaking public access improvements at the loth Street boat launch <br />for a minimum of 2% of the final costs for the reconstruction of Pier 1 <br />(SMA #6-90) and for the instant project. Current estimates of the 2% <br />value is $300,000.00. <br />7. In the event that public access improvements at the loth Street boat <br />launch are not carried out as stated in condition 6 above, then the <br />Port will be required to make alternative public access improvements at <br />a location and at a value to be determined by the My of Everett. <br />8. Prior to issuance of Building Permits, the Port of Everett must have a <br />Landscape Architect submit recommendations for providing a Type III <br />landscape screen along the west margin of Terminal Avenue from the <br />access of the Port Office to a point parallel to the northern margin of <br />Pier 3. The recommended landscaping improvements must be installed as <br />part of this project. <br />9. Building Permits must be obtained for the new structures to be <br />constructed as part of this proposal and, if required, for those <br />structures to be removed. <br />10. Signs must conform to the standards contained in Section 36 of the <br />Everett Zoning Code, Category "C." If any signs are proposed, a sign <br />plan must be reviewed and approved by the Planning Department prior to <br />the issuance of any building permits. <br />Done and dated this 19th day of April, 1991. <br />;J, <br />Jame .
