The Hearing Examiner of the City of Everett has jurisdictional authority <br />to hold a hearing and to issue a decision based on the authority granted <br />him in EMC 20.12.1_0(A)(2). <br />5. EMC 20.12.070 establishes the criteria for the issuance of Shoreline <br />Management Substantial Development Permits. The permit is granted only <br />when the proposed development is consistent with the policies and <br />procedures of the Shoreline Management Act of 1971; the Department of <br />Ecology Shoreline Management Act of 1972; the Everett Shoreline Master <br />Program; and the State Environmental Policy Act. The proposed project <br />has been reviewed pursuant to these pieces of legislation and with <br />conditions of approval as set forth in this decision, the proposed <br />improvements to Pier 1 and Pier 3 will satisfy these criteria. <br />6. EMC 20.12.130(6) establishes the authority of the Hearing Examiner to <br />attach conditions, modifications, and/or restrictions on the location, <br />character, or any other features of the proposed development that are <br />necessary to make the Shoreline Management Substantial Development <br />Permit and the development satisfy the criteria as set forth above. <br />7. The subject property is located in an Urban Developed and Redeveloped <br />Environment as set forth in the Everett Master Program. The relocation <br />of the Alumina handling facility on Pier 1 to Pier 3 and the associated <br />activities with the handling facility have been reviewed pursuant to the <br />policies, goals, and criteria of this designation. With conditions as <br />imposed herein, the proposal will satisfy these goals and policies. <br />8. No significant impact to the water quality of Puget Sound will occur as <br />a result of the improvements to the pier and to the handling system. <br />With the improvement of the conveyance of the Alumina from ship to <br />storage dome, the water quality will be improved because the removal of <br />any Alumina particles being put into the water. <br />9. The construction and design of the facility and the adherence to the <br />development standards for M-2, Heavy Manufacturing zoning will have a <br />positive impact in the area and will not be detrimental to other <br />developments. <br />10. The proposal will not result in any dredging activity. <br />11. Pursuant to the State Environmental Policy Act, the Port of Everett was <br />designated as the lead agency for the SEPA review. The Port of Everett <br />issued a Mitigated Determination of Non -Significance. No appeal was <br />filed of that Determination. <br />12. The piers and the handling facility will be improved in a manner that is <br />consistent with the policies and the use regulations as set forth in the <br />Everett Master Program. It will be consistent because there are no <br />conflicts with the development of the pier for industrial purposes with <br />public safety. The pier will be improved to enable emergency equipment <br />vehicles and personnel to reach all surface areas of it. <br />
